These Terms of Service (“Terms”) govern your access to and use of the website located at https://txdroofing.com (the “Site”) and the communications and services offered by Texas Direct Roofing & Construction (“Texas Direct Roofing,” “we,” “us,” or “our”). By accessing the Site, submitting a request, or enrolling in our text-messaging program, you agree to these Terms. If you do not agree, please do not use the Site or our services.

About Our Services

Texas Direct Roofing & Construction has been a roofing and outdoor living contractor since 2017, providing roof repair and replacement, emergency tarping, gutter installation and repair, window replacement, solar panel installation, outdoor living, remodeling, and related construction services in Texas. Information on the Site is provided for general informational purposes and does not constitute a binding offer, warranty, or guarantee of any specific result, price, or availability.

Estimates, Quotes, and Agreements

Free inspections, estimates, and quotes are provided based on the information available at the time and are subject to change following inspection, material costs, and site conditions. Any work we perform is governed by a separate written contract or work order signed by you and Texas Direct Roofing, which will control in the event of any conflict with these Terms. Submitting a request through the Site does not create a contract for services.

Mobile Messaging Terms (SMS/MMS Program)

By providing your mobile telephone number to Texas Direct Roofing & Construction and opting in, you agree to these Mobile Messaging Terms.

Program description. Texas Direct Roofing & Construction offers an SMS/MMS messaging program (the “Program”) that allows us to communicate with you by text message. Messages may include appointment and inspection reminders, scheduling and project confirmations, status updates, responses to your questions, customer-care messages, and — where you have separately opted in — promotional offers and announcements.

Consent. When you provide your mobile number through our website forms, by text, in person, or by phone and agree to receive texts, you consent to receive recurring automated text messages from Texas Direct Roofing & Construction at the number provided. Consent is not a condition of purchase of any goods or services. You represent that you are the account holder or have authority to consent for the number provided.

Message frequency. Message frequency varies based on your interactions with us.

Costs. Message and data rates may apply. Texas Direct Roofing & Construction does not charge for the messages, but your mobile carrier’s standard message and data rates may apply depending on your plan.

Opt-out. You may opt out of the Program at any time by replying STOP to any message you receive from us. After you reply STOP, we will send you one confirmation message and will not send you further texts unless you opt back in. You may also contact us at (817) 775-3540 to be removed.

Supported carriers and delivery. Carriers (including, but not limited to, AT&T, T-Mobile, Verizon, and their affiliates) are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed.

Privacy. Information you provide in connection with the Program is handled in accordance with our Privacy Policy. No mobile information or text-messaging opt-in data and consent will be shared with third parties or affiliates for marketing or promotional purposes.

Changes. We may modify or terminate the Program, or any of these Mobile Messaging Terms, at any time without notice.

Use of the Site

You agree to use the Site only for lawful purposes. You may not:

  • Use the Site in any way that violates applicable law or regulation;
  • Attempt to gain unauthorized access to the Site, its servers, or related systems;
  • Interfere with or disrupt the Site or introduce malware or harmful code;
  • Use automated means to scrape, harvest, or collect information from the Site without our permission;
  • Submit false, misleading, or fraudulent information.

Comments and User Submissions

If you post comments or submit content to the Site, you are responsible for that content and grant us a non-exclusive, royalty-free license to use, display, and reproduce it in connection with the Site. We may moderate, edit, or remove content at our discretion. Do not submit content that is unlawful, infringing, defamatory, or otherwise objectionable.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TEXAS DIRECT ROOFING & CONSTRUCTION AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THE MESSAGING PROGRAM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

Indemnification

You agree to indemnify and hold harmless Texas Direct Roofing & Construction and its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your submissions, or your violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Tarrant County, Texas.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above. Your continued use of the Site or the Program after changes are posted constitutes acceptance of the updated Terms.
